Terms and Conditions – Cartwright Co Giveaways
The following terms and conditions are accurate and effective as of 1st July 2024.
The CARTWRIGHT COMPANY PTY LTD (ABN 35 671 982 004) (hereafter referred to as ‘Cartwright Co’, ‘we’, ‘us’, or ‘our’) conducts trade promotion giveaways on touring equipment and vehicles to the individuals in the general public (hereafter referred to as ‘Public Participants’) and to our VIP Members (hereafter referred to as ‘Member Participants’) through our website.
Definitions
The following definitions apply to these Terms and Conditions:
Entries | Refers to each individual ticket held by Public and Member Participants for Cartwright Co Giveaways. The number of entries allocated to each Public Participant in General Public Giveaway is dependent on the number of One-Off Packages that they purchase. The number of entries automatically allocated to each Member Participant depends on their Membership Tier and the balance of their accumulated entries. General Public Giveaway | Means giveaways which are available to members of the General Public through purchase of a One-Off Package. VIP Members receive free entry into General Public Giveaways by virtue of their Membership with Cartwright Co. |
One-Off Purchase Package (‘One-Off Package’) | Refers to the packages which Individuals (including VIP Members) are able to purchase through our website which provides free entry into Cartwright Co General Public Giveaways. See clause 2 for details of the benefits of One-Off Packages. |
Participant | Refers to both Public and Member Participants. |
Public Participant | Refers to individuals who obtain free entry into a Cartwright Co General Public by purchasing a One-Off Package. |
VIP Member/ | Refers to individuals who purchase a VIP Membership in accordance with our VIP Member Terms and Conditions. |
Member Participants | Refers to individuals with a VIP Membership who have received free entry into a VIP Member Giveaway or a General Public Giveaway by virtue of their Membership with the Cartwright Co. |
VIP Member Giveaways | Refers to the giveaways available to VIP Members pursuant to clause 3 of these Terms and Conditions and clause 2.5 of our VIP Member Terms and Conditions. |

1.Eligibility – General Public Giveaways
1.1 General Public Giveaways are open to both Public Participants and Member Participants (collectively referred to hereafter as ‘Participants’).
1.2 Participants must be Australian residents (excluding SA) over the age of 18.
1.3 Participants may purchase a One-Off Package through our website to receive free entry to our General Public Giveaways. Each Participant may purchase more than one One-Off Package and therefore hold more than one entry in General Public Giveaways. There is no limit to the number of One-Off Packages a Participant can purchase during the Promotional Period.
1.4 Employees of Cartwright Co Pty Ltd and their immediate family members (parents, spouses, domestic partners, siblings and children) or any other person residing in an employee’s household are not eligible to enter General Public Giveaways.
1.5 Member Participants are automatically entered into General Public Giveaways. The number of entries automatically allocated to each Member Participant depends on their Membership Tier and the balance of their accumulated entries. See our VIP Membership Terms and Conditions for more information.
1.6 All One-Off Package purchases are final and non-refundable.
1.7 By purchasing a One-Off Package from our website, you agree to be bound by these Terms and Conditions.
2. One-Off Package Inclusions
By purchasing a One-Off Package from our website, you will receive the following benefits:
2.1 Leading industry discounts on Vehicles, Caravans and Touring accessories. These discounts are only available to Cartwright Company Participants and cannot be obtained elsewhere
2.2 Discounts on our huge range of touring apparel, garments and accessories
2.3 Tickets to Cartwright Company meet and greets where participants get to meet The Cartwright family.
3. Eligibility – VIP Member Giveaways
3.1 For an individual to be eligible to enter exclusive VIP Member Giveaways, they must purchase one of our official VIP Memberships from our website. They will then automatically be entered into our VIP Member Giveaways.
3.2 Each VIP Membership is entitled to one entry into our VIP Member Giveaways.
3.3 Individuals can hold more than one VIP Membership at the same time.
3.4 By becoming a VIP Member, you agree to be bound by these Terms and Conditions, and the VIP Membership Terms and Conditions, which are available here.
4. Participant Cap
4.1 Cartwright Co may, at its sole discretion, limit the number of Participants into each General Public Giveaway. The Participant Cap for each giveaway is advised in the schedule above.
4.2 VIP Members are not counted towards the Participant Cap for General Public Giveaways.
4.3 Once the cap has been reached for General Public Giveaways, we will advertise as such on the Giveaways page on our website and on our social media accounts.
4.4 The Participant Cap does not affect the operation of clause 1.3 of these Terms and Conditions. Participants may purchase as many One-Off Packages as they like. Multiple packages purchased by the same person do not count towards the Participant Cap.
The following clauses 5 to 9 apply to BOTH General Public Giveaways and VIP Member Giveaways:
5. Prize Draw
5.1. Prize Winners are selected at random using our Automated website programming. Every Participant has a random, fair and equal chance of winning.
5.2. Prize Draws will be scrutinised by an independent third party.
5.3. Giveaway winners will be notified by email and/or phone on the date of the prize draw on the 29th of November 2024. Winners will also be published and announced on our social media platforms including Facebook and Instagram.
5.4. Live draw will be held at Discovery Parks Karratha, 70 Rosemary Rd, Karratha WA 6714.
5.5. Winner will be posted on the website on the 29th of November 2024
5.6. If a Participant’s contact details change during the giveaway Promotional Period, it is their responsibility to notify us of this change by contacting us, or in the case of VIP Members, by updating their information on their Account Dashboard on our website.
5.7. If the Prize Winner cannot be contacted within 90 days, a redraw will take place including the names of all remaining Participants who initially entered the Giveaway. Participants will be notified of the date of the prize redraw by email. This information will also be published on our website and our social media accounts.
5.8. We reserve the right to disqualify any Giveaway Participant found to be tampering with or otherwise abusing any aspect of our giveaways, as solely determined by us. We reserve the right to seek damages against any Giveaway Participant who deliberately damages our website or undermined the legitimate operation of our Giveaways.
5.9. In the event a Giveaway is compromised or tampered with by non-authorised human intervention beyond our reasonable control which would impair the administration, security, fairness or proper operation of the Giveaway, we reserve the right to suspend, modify or terminate the Giveaway.
5.10. We do not accept responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
5.11. if the prize is unclaimed for longer than 90 days from the initial draw, we will make an announcement on the 27th of February 2025 and then conduct a redraw on the 13th of March 2025 at 1pm, at Wonderland Caravans Showroom. The Redraw will be conducted Via Automated website program, every Participant has a random, fair and equal chance of winning. The winner will be drawn and contacted immediately via phone and email. The winner of the redraw will be published to our Facebook, Instagram and website on the 13h of March 2025. You can view the winners via this link: www.Cartwrightco.com.au
6. Prizes
6.1 The Giveaway Prize cannot be exchanged, transferred, or redeemed for cash.
6.2 If the particular Giveaway Prize is unavailable, for whatever reason, we reserve the right to substitute the prize for a similar prize of equal or greater value.
6.3 To the extent permitted by law, each Giveaway Prize must be taken as stated and we make no representations or warranties that are not expressly stated in these terms. No compensation will be payable if a Prize Winner is unable to use the Giveaway Prize as stated.
6.4 Independent financial advice should be sought as tax implications may arise as a result of accepting the Giveaway Prize.
6.5 In the event that the Giveaway Prize is a motor vehicle:
6.5.1 The Prize Winner is solely responsible for paying any duties, taxes, registration fees, fuel, parts, servicing and operating costs associated with the vehicle.
6.5.2 If the vehicle is advertised as not being road legal, the Prize Winner acknowledges that we will not be responsible for any costs associated with making the vehicle compliant with any laws.
6.5.3 If the vehicle includes custom modifications, the Prize Winner acknowledges that replacement parts may not be available in the future.
6.5.4 The Prize Winner acknowledges that we will not be responsible for any costs associated with any costs of maintenance, operation or any other costs that are not expressly stated in these terms.
6.6 We are not liable for any damages incurred to any prizes after delivery. Prize Winners will have 24 hours to bring any issues or imperfections forward to us for review regarding prizes before they are deemed to have been accepted in the condition it arrived.
6.7 We do not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and we shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with a Giveaway Prize except for any liability which cannot be excluded by law.
7. Delivery
7.1 We aim to deliver the Giveaway Prize to the winner within 30 days. This is subject to the Giveaway Winner’s response time, location, and availability. We do not accept any responsibility for late delivery of the Giveaway Prize.
7.2 We cover the costs of delivering the Giveaway Prize to the winner Australia-wide.
8. Representations
8.1 Participants represent and warrant that they shall not contact any affiliate, employee, sponsor, or partner of Cartwright Co to manipulate Giveaway results.
9. Warranties
Cartwright Co warrants the following:
9.1 We have the legal right to give away the prizes specified in the schedule.
9.2 The purpose of our Giveaways is to promote the Cartwright Co brand and bring awareness to our YouTube channel and apparel.
9.3 We do not sell raffle tickets or any other form of ticket to enter our giveaways. Entries to our Giveaways cannot be purchased and will not be sold separately.
9.4 All One-Off Packages and VIP Memberships include a specified number of free entries into our Giveaways.
9.5 Entry to our Giveaways are strictly provided as promotional gifts to VIP Members and the General Public.
9.6 Our Giveaways can be won by any Participant who purchases a One-Off Package or VIP Membership from our website, or any official link, and meets the conditions of entry.
9.7 Our Giveaways are solely promoted by Cartwright Company Pty Ltd (ABN 35 671 982 004).
10. Disclaimers
By becoming a VIP Member or purchasing a One-Off Package through our website, Participants agree that:
10.1 Any and all disputes, claims and causes of action arising out of, or in connection with the Giveaway and the Prizes shall be resolved individually without any form of class action.
10.2 Any claims, judgments and awards shall be limited to actual out of pocket costs incurred in entering the Giveaway, but under no circumstances will Cartwright Co be responsible for any legal fees.
10.3 Participants hereby waive all rights to claim punitive, incidental, or consequential damage and any rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out of pocket expenses incurred in entering the giveaway
10.4 In no event will Cartwright Co, their licensees, parents, affiliates, subsidiaries and related companies, their advertising or promotional agencies or their respective officers, directors, employees, representatives and agents, be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising from access to, or use of, the website, electronic or computer malfunctions, or participation in this giveaway, even if Cartwright Co was advised of the possibility of such damages.
10.5 Cartwright Co assumes no responsibility for any problems or technical malfunction of computer systems, servers, software, internet service providers, or e-mail systems, failure of any entry to be received on account of technical problems or incomplete, late, lost, damaged, illegible, or misdirected electronic communications, or any combination thereof.
10.6 The Giveaway is void where prohibited or restricted by law.

The following terms and conditions are accurate and effective as at 30 July 2024.
The CARTWRIGHT COMPANY PTY LTD (ABN 35 671 982 004) (hereafter referred to as ‘Cartwright Co’, ‘we’, ‘us’, or ‘our’) offers VIP Membership for individuals (hereafter to as ‘Members’, ‘you’, ‘your’ or ‘them’) to our online platform.
VIP Membership provides members with access to Australia’s largest touring discounts, as well as discounts on Cartwright Co apparel and entry into Cartwright Co Giveaways and exclusive VIP Member Giveaways.
Each VIP Member is bound by these Terms and Conditions.
1. VIP Membership Eligibility
1.1 VIP Membership is open to all Australian residents over the age of 18.
1.2 Each application for VIP Membership is subject to acceptance by us, at our absolute discretion.
1.3 Only individuals can apply for VIP Membership. Corporations, partnerships, trusts, and other entities are not eligible to be VIP Members.
1.4 VIP Membership is not limited to one membership per person. Individuals can become a VIP Member as many times as they want to increase their chances of winning our Giveaways (see Clauses 2.2 and 5 below).
2. Benefits
2.1 There are four tiers of VIP Membership, which provide the following perks:

2.2 VIP Members who are residents of South Australia are not eligible to enter our General Public Giveaways or our VIP Members Giveaways. Giveaway entries will not be issued to residents of South Australia.
2.3 Cartwright Co Giveaways
a. VIP Members are automatically entered into every Cartwright Co Giveaway that is open to the general public (hereafter referred to as ‘General Public Giveaways’). This is separate to our exclusive VIP Members Giveaways.
b. By becoming a VIP Member you agree to the Giveaway Terms and Conditions, which are available here
c. VIP Members receive a set number of entries to our General Public Giveaways each month (or each year), depending on their Membership Tier. Giveaway entries accumulate over time, so the longer you are a VIP Member, the more entries you will have to each General Public Giveaway. You can check your entry balance on your Account Dashboard on our Website.
d. The balance of your entries into the Giveaways never decreases.
e. VIP Members can also purchase Packages through our website to obtain additional free entries to our General Public Giveaways through the Giveaway page on our website. There is no limit on the number of entries an individual can have in our General Public Giveaways.
2.4 Cartwright Co Apparel Discounts
Cartwright Co apparel discounts are automatically applied to your cart when you are logged in to our website. It is your responsibility to ensure that you are logged in to our website when you make apparel purchases. We do not provide refunds or reimbursements if you miss out on your discount for Cartwright Co apparel because you were not logged in when your purchase was made.
2.5 VIP Members Giveaways
VIP Members are automatically entered into our exclusive VIP Members Giveaways. Each member is given 1 entry into these giveaways.
3. Membership Fees
3.1 Each VIP Membership tier incurs a distinct fee:

3.2 From time to time, we may offer different membership programs and the fees and terms for such different memberships may vary.
3.3 You will find details about the Membership tier you are subscribed to, the applicable membership fee, and the next billing date in your Account Dashboard on our website.
3.4 Any increase in the applicable VIP Membership fee will not apply before the end of your current Membership billing period.
3.5 Auto Renewal
a. The billing date of your VIP Membership is determined by the date that you become a VIP Member. You will get billed on the same date of every month (or in the case of Platinum Membership, every year).
b. Unless you notify us before the next billing date of your membership fee that you want to cancel your membership, you understand that your membership will be automatically renewed. You authorise us to charge the then-applicable periodic membership fee using your preferred payment method.
3.6 Payment Method & Missed Payments
a. If your preferred payment method becomes invalid during your membership period, or if the charge is refused for any other reason outside our control, you authorise us to use any other payment method we have on file in your VIP Membership account.
b. If all your payment methods on file are declined, you must provide us a new eligible payment method within 7 days, if you have an annual membership, or within 30 days. If you fail to provide us with a new eligible payment method within these timeframes, your membership will be cancelled.
c. If you miss a payment of your Membership Fee, your entries to the General Public Giveaways will automatically reset to zero.
4. Cancellation
4.1 You may cancel your VIP Membership any time by visiting your Account Dashboard on our website and adjusting your membership settings. You may also contact customer service.
4.2 Cancellation of your membership will take effect at the end of the current billing period. Your VIP Membership fee for the current billing period is non-refundable.
For example, if you have a monthly membership which is billed on the first day of each month, and you cancel your membership on the 15th day of the month, your cancellation will take effect from the first day of the next month. Your membership fee for the current month will not be refunded, in part or otherwise.
5. Privacy
5.1 We collect your personal information in order to provide our VIP Membership benefits. This personal information includes your name, address, email address, phone number and bank account and/or credit card details for agreed billing purposes. Your personal information is dealt with in accordance with these Terms and Conditions.
5.2 Your personal information may be collected through correspondence to us, when you use our website, or when you purchase a VIP Membership or other products or services from us, and from cookies.
5.3 We collect your personal information for the primary purpose of providing our services to you. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. These include administration needs, dealing with your feedback and requests, conducting research and development in respect of our services, and preventing and detecting any misuse of this website.
5.4 Your Personal Information may be disclosed in a number of circumstances including the following:
a. to our employees, related companies and professional advisers such as our lawyers;
b. law enforcement agencies to assist in the investigation and prevention of criminal activities;
c. credit-reporting and fraud-checking agencies;
d. organisations who manage our business strategies;
e. third parties where you consent to the use or disclosure; and
f. where required or authorised by law.
We may also disclose anonymised information to third party contractors or service providers with whom we have a business association, including integration providers, marketing service providers, accounting services providers, and information technology service providers including cloud application providers.
5.5 Your personal information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.
5.6 When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.
5.7 Upon becoming a VIP Member, you are opted-in to receiving email communications from us regarding promotions and giveaways. You may opt-out of these communications through your Account Dashboard or through our marketing emails. We may nevertheless periodically send information to you about your Membership.
6. Agreement and Service Changes
6.1 We may in our reasonable discretion change these Terms. Any changes implemented by us will not affect your rights to cancel your membership auto renewal at any time.
6.2 Where we make a materially adverse change to these Terms, as reasonably determined by us, we will provide you with prior written notice via email or reasonably substitutable means.
6.3 If any change to these Terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. Your continued VIP Membership and use of the VIP benefits provided to you after any such change constitutes your acceptance of the change. If you do not agree to any changes, you must cancel your membership in accordance with Clause 4.
7. Applicable Law, Disputes, Disclaimer and Liability
7.1 These Terms and Conditions are governed by and are to be construed in accordance with the laws of New South Wales.
7.2 Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the Courts of New South Wales and Courts entitled to hear appeals from these Courts.
